Who should use the I 824 Form?

When you file a petition to bring your spouse and children to the United States, or request for employment authorization, or request to adjust your status to permanent resident, or send any other petition to USCIS, you will be sent a notice of action after your application is received by USCIS. This notice of action is otherwise called Approval Notice (Form I 797). This is the first step in your application process. If you lost your original approval notice you may request a duplicate approval notice. Or if you request an approval notice to be sent to another U.S. Consulate, or request an approval notice be sent to a U.S. Consulate for derivative visas for family members, you must then file the I 824 form (Application for Action on an Approved Application or Petition).

Application for Action on an Approved Application or Petition

The approval notice will contain the name of the applicant, personal information, beneficiary's name (if any), receipt number, receipt date, type of your notice, priority date, the class and the validity of your petition. You may use the receipt number to check the status of your USCIS petition.

You must file I 824 form at the USCIS office that approved your original application or petition, if

  • you lost your original approval notice, or
  • you never received the approval notice, or
  • you request an approval notice be sent to another U.S. Consulate to notify the approval on your petition, or
  • you request that a U.S. embassy or consulate be notified that your status has been adjusted to permanent resident, so your spouse and children may apply for immigrant visas.

The I 824 form must be filed while the original application or petition is still in effect. The duplicate approval notice will contain only the information that is in the original approval notice. It will not include other any other USCIS authorization document that was accompanied with your original approval notice. All I 824 forms are required to be accompanied with the supporting documents. You must send a copy of your original petition or application. You must also include a copy of the approval notice for the original petition.

A separate I 824 form must be filed for each petition with USCIS. The I 824 petition must not be used if you wish to know the status of your pending application whether your application will be approved or denied.

Process Involved:

Any I 824 application that has been submitted to USCIS is not correct or not accompanied with the correct fee and required documents, the application might be denied. You are then required to gather all the supporting documents and provide correct information and resubmit the application for approval notice. Once your I 824 form is received by USCIS, they will check the application for completeness. The USCIS might require more evidence and also might request you to appear for an interview with them. The decision on your application (whether approved or denied) will be sent to you in writing.
