To the United States - according to their new procedures, in order to get a visa, all those who request one, between the age of 16 and 60 are demanded to arrive to the embassy or to the general consulate in Jerusalem to submit the request. To minors between the age of 7 and 17 that travel alone, add parent's approval saying that they are financing the trip and that their child is continuing studying. You need to add the last three paychecks of each parent. Moreover, the parents need to bring an approval from his school saying that this student is indeed studying there (with the school's logo of course).

Released soldiers (in the last 5 years), must add their release certificate from the army. Whoever got released and it has been a long time since the release date and hasn't worked in a neat work or hasn't studied for a long time since the army - will have difficulties getting a visa.

Degree's students should bring an approval from their college or university saying that they are listed there, another approval that says that their tuition has been paid or an approval that says that they are doing a course preparation there. The approval needs to be in the English language.

In case you immigrated to Israel since 1996 and onwards, you must add your immigration certificate.

Working people need to add an approval from their employer, with the company's logo on the page. Moreover, the worker's name, job, seniority (from which date), ending date of his vacation, approval that he is going to keep working there after he returns + copies of the last three salaries, need to be written on the page.

Seniors - confirmation from the national insurance that he/she receives pension.

Seniors that haven't reached the age of 67 need to add copies of their last three paychecks.

Independents - need to bring a document from the company's attorney that specifies the business essence, its seniority, and document's writer's job.

In case someone stole or you have lost your old passport with the valid visa, bring with you a document from the interior ministry that approves it and with all of your exits and entries to the country.

If you own your old passport with a valid visa to the United States, attach the old passport to the new passport that you have. The old passport gives you entrance to the United States even though the old passport has expired in Israel.

The passport pictures you submit need to be shot close to the time of the request. The picture must be different from the picture in the passport, otherwise you might not get approved. The pictures need to be 5X5 centimeters, without a hat, glasses and both ears visible, on a white background.

It is not recommended to bring more than 10 thousand dollars since it raises the suspicion for drugs trading or any other illegal trading.

In case you fly to Canada or any other countries that go through the United States, you need to receive a visa for the United States.

For all those who receive visa: whoever enters the United States as law but doesn't leave a day before his visa expires, risks in a criminal offense, and whoever stays beyond the time allotted him, breaks the law and might not get a visa in the future.

There is no formula that will bring you the visa, the purpose of the interview in the embassy is to ensure that you are not going to settle down in the United States. We remind you to provide the consulate all the relevant documents, which prove your intention of coming back home.

And of course you will be needed to pay the fee again, at the sum of 100$, and prepare all the relevant documents again, and go through the agent, commissions, etc. you can demand not to do the interview with the same interviewer you've had in the consulate (if you remember his/her face).

For Arab-born population, which country of origin is defined by the American government as terror countries (like Sudan, Syria, Libya, South-Korea and Cuba), will have to wait with the request for about a month (the request is transferred for a more careful examine at the different government agencies in Washington). Those who country of origin is no longer defined as terror countries (like Egypt, Morocco, Yemen, and Iraq), will have to wait between two and three weeks.

The visa renewal procedure is to request for extension through the travelling agent in an organized way, no longer than one year since the visa expired. If you follow these procedures, you might not be invited for an interview in the embassy and get your visa through the agent. If you request for an extension of the visa for over a year since the visa has been expired, you would probably be invited for a new interview in the embassy.

Extending the visa to the United States has its own procedure, and therefore forms need to be filled out (they can be downloaded from the internet or get them from the IRS - the immigration offices), paid for (the price is written in the site) and sent to the immigration offices (IRS). A person physically in the United States, who expresses a fear of persecution on account of race, religion, nationality, political opinion, or membership in a particular social group, is eligible to apply for asylum.   • Be harmed or fear harm by parts of the government. The police and the army are parts of the government. Harm by right-wing or left-wing political groups or religious zealots that the government is "unable or unwilling to control" also meets the demands of asylum laws.
  • Be affected by at least one of several defined conditions. As suggested above, these conditions are: political opinion, race, religion, nationality, and social group. The last category, social group, usually refers to people with certain characteristics that a particular society might lump together and about which it generally has an unfavorable attitude, such as homosexuals. The law generally does not include people who fled their homes due to civil wars, generalized violence, or criminal prosecution. However, one of these reasons may suffice for asylum if it can be connected to one of the five listed conditions.
  • Not be a danger to the community. Finally, international law recognizes that countries have the right to exclude asylum seekers who may be a danger to society. Those excluded are those who have committed "particularly serious crimes," including aggravated felonies as defined in INA 101(a)(43), pose threats to national security, or who have committed war crimes or "crimes against humanity."

Bars to Seeking Asylum
Even if you meet the above criteria for asylum, you may be barred from seeking asylum under certain circumstances. Some of the bars to asylum include but are not limited to:

  • conviction for a "particularly serious crime" (includes aggravated felony convictions)
  • committed a serious nonpolitical crime outside of the United States
  • poses a danger to the security of the United States
  • has engaged, ordered, assisted, or otherwise participated in the persecution of any person on account of race, religion, nationality, membership in a particular social group, or political opinion

Warning Against Filing a Frivolous Asylum
If you file a frivolous asylum application, you will be PERMANENTLY BARRED from seeking any form of discretionary relief in the United States, including adjustment of status, cancellation of removal, or voluntary departure.

For immigration purposes, an asylum application is frivolous if any of its material elements is deliberately fabricated.

Remember, the credibility of your claim is at issue in an asylum case. What you write in your application, and what you say under oath in an asylum interview or in an immigration court, will decide whether you are a credible person and have a credible claim.

If the immigration judge finds that you have filed a fraudulent asylum application, not only will you have a deportation order that will be difficult to reverse on appeal, but you will never be able to apply for any other form of discretionary relief!

So, if you knowingly submit a fraudulent asylum application, you are subject to the harsh penalty of permanently becoming ineligible for other relief, regardless of sympathetic circumstances.

A frivolous finding is basically a "death sentence" for immigration purposes, so you should never file a frivolous application.

Withholding of Removal (INA 241(b)(3))
The Attorney General may not remove a person to a country where his or her life or freedom would be threatened because of his or her race, religion, nationality, membership in a particular social group, or political opinion.

To win a claim for withholding of removal, you must show that there is a "clear probability" that you will be subject to persecution if forced to return to the country of removal, or that it is "more likely than not" that you would be persecuted if you are removed to the home country.

Of course, this is a higher burden of proof than the showing of "past persecution or a well-founded fear of future persecution" required for asylum. However, unlike asylum, which is a discretionary form of relief, withholding of removal is mandatory once you establish that your life or freedom would be threatened in the proposed country of removal on account of race, religion, nationality, membership in a particular social group, or political opinion.

If granted withholding of removal under INA 241(b)(3), the applicant can remain in the United States, but can NOT be granted lawful permanent resident status (green card) on that basis.

Additionally, a grant of withholding of removal only means that you cannot be deported to your native county; if and when the United States government finds another country that will accept you, you will be deported to that country.

Convention Against Torture (CAT)
Article 3 of the United Nations Convention Against Torture protects aliens who fear torture in their native country. Unlike asylum and withholding of removal, CAT does not require that the alien be persecuted on account of race, religion, nationality, membership in a particular social group, or political opinion.
Convention Against Torture is a treaty that prohibits the return of a person to a country where there are substantial grounds for believing that the person would be in danger of being subjected to torture if returned to his or her native country.

"Torture" is defined in Article 3 of CAT. There are no bars to eligibility for Convention Against Torture, and those who do not qualify to seek asylum can nonetheless seek protection under CAT.
To win a Convention Against Torture claim, you must prove that it is "more likely than not" that you would be subject to torture if forced to return to your native country.

If you are granted protection under Convention Against Torture, you cannot be removed from the United States to the country from which you fear being tortured, but you can be removed to any other country if that county will accept you.

A grant of CAT relief does not entitle you to become a lawful permanent resident (green card holder). However, based on such a grant of relief, you can obtain an employment authorization document (EAD) and can reside and work lawfully in the United States.

Competent Representation is Key
As it is true about any other area of immigration law, competent representation of your asylum claim is key in putting forth the best and strongest possible application. If you wish to seek asylum, withholding of removal, or relief under Convention Against Torture you are required to file Form I-589. Form I-589 covers all of these forms of relief. There is no filing fee associated with an application for asylum.

Be careful of lawyers or representatives who "promise" you that you will win your asylum case and that you have "nothing to worry about"! You should consult competent attorneys prior to filing an application for asylum, because there are severe consequences for filing a fraudulent asylum application before an Immigration Court. While those who "promise" you a victory have nothing to lose if you do not win your asylum case, you have everything to lose! Do not take unnecessary risks!

Secured Lending In Canada

There are various types of secured lending in the Canadian business environment. Let's examine some of those secured loans and discuss some of their characteristics.

When most business owners or financial managers think of secured lending they are thinking in terms of their operating loans or operating lines of credit, sometimes called ' revolvers' in finance language.

These loans are used to financing working capital, primarily receivables and inventory. In taking and registering this security the bank or some similar financial institution will take an assignment of these 'liquid assets' of the company. On occasion customers will hear the term ' demand loan ' and we are in effect talking about the same thing.

How does the bank or other institution secure the loan? They register what is known as a General Security Agreement, commonly called a 'GSA 'against the business. In determining their security and overall all 'credit limit' with the customer they usually agree to advance against 75% of all good receivables, and some component of inventory. We can, as a general rule, say that banks don't really like inventory - simply because they aren't set up to liquidate on it when they have to. If everything goes well that is as much as the business owner really needs to know. The loan is secured, the bank registers a public security against the company, and the company has access to working capital.

How does the Secured Lender realize on the security? Again, we are talking about the worst case scenario when a bank has determined it needs to 'call the loan ', terminology most business owners know too well but hope they never have to live through. The bank is in effect, at that time, attempting to crystallize on its loan. In securing the loan we spoke of the bank or other lending institution taking an assignment of the assets. Now that the loan has been called an actual assignment is enforced - customers are notified by the bank and monies are collected by the bank to reduce the loan outstanding. The bank now finds itself in a position of having to deal with the inventory they did not want to deal with, and we typically find that the inventory is directed to be sold by an auctioneer or salvage firm, who acts as a temporary agent for the bank.

When loans are enforced in such a manner the results are usually disastrous for the customer and have a major impact on the company's ability to go forward.

Lenders securities agreements in Canada are all registered under Canada's Person Property Security Act, and are in effect public knowledge for those that wish to investigate secured dealings. This process is very similar to the UNIFORM COMMERCIAL CODE (UCC) that exists in the U.S., and in fact the security legislation in Canada was very closely model to the U.S. way of secured lending notification.

There are other forms of secured lending Vis Vis equipment, debentures, and security is generally handled in the same manner re: registration, etc.

United States Fiance Visa: Do We Need to Meet Before we can get a K1?

The K1 fiance visa is a category stipulated in Immigration law that allows the unmarried betrothed of an American Citizen the right to travel to America in order to execute a legal marriage in one of the 50 states. 00004000 Each year, many people attempt to obtain this type of visa and become confused about the requirements for obtainment.

At the same time, acquiring a US fiance visa is possible, but US immigration law imposes certain requirement before one may do so. Many stipulations can be circumvented, but others must be adhered to.

An inflexible regulation governing K1 visa law is the provision that both the K1 visa petitioner and beneficiary must have been in each other's physical presence before the USCIS, the descendant of the INS, will grant a fiance visa.

When they enacted the legislation promulgating the K-1 visa, the legislators made it very clear that the visa petitioner and beneficiary ought to have met at least once before a fiancee visa should be issued. Inherent in a K-1 visa application there is a requirement that the relationship between the parties must be genuine. One factor that tends to prove the bona fide nature of a relationship is the fact that both parties have met in person. Even in the computer age where a very genuine and caring relationship can arise between two people utilizing online chat, email, and two way video; US Immigration law still mandates that those in a bona fide relationship meet 1 time if a K1 application is to be granted approval. In extenuating circumstances a K-1 visa application might be approved by USCIS where the couple has never been together, but that scenario would be very out of the ordinary. In many cases, an example of this type of hardship exists where the US Citizen has some sort of debilitating illness.

This showing of extreme hardship is akin to an I-601 waiver of inadmissibility which requires a showing of extreme hardship in order for a finding of a legal ground of inadmissibility to be waived.

What Supporting Documents Do I Need To Submit With The Form I-751, Petition To Remove The Conditions

Form I-751, Petition to Remove the Conditions on Residence is a petition used to remove the conditons on residence. If you are a conditional resident and obtained the conditional status through marriage, then you should use Form I-751 for removal of conditions. Supporting documents with Form I-751 include certain intial evidences like copy of Permanent Resident Card. Form I-751 can be filed jointly or you could seek a waiver in the joint filing requirement.

The following supporting documents with Form I-751, should be submitted to the USCIS:

  • Copy of the front and back of your Permanent Resident Card.
  • Evidences to prove that your marriage is legitimate.
  • Evidences for seeking a waiver (If filing to waive the joint filing requirement)
  • Court order if you have changed your name legally.
  • English translation of all foreign language documents from an authorized translator.

You have to submit evidences to prove that your marriage is legitimate and that you have not violated any law of the United States. To prove the evidence of your marriage, the following supporting documents with Form I-751 should be submitted:

  • Copy of your marriage certificate.
  • Copy of birth certificates of the children you have had together.
  • Documents of Joint ownership or property such as financial records of assets, federal tax return, insurance policies.
  • Rental receipts of all the apartments that you have occupied together.
  • Affidavits from atleast two people, who have personally known you and your spouse from the time the conditional residence was granted. The person who signs the Affidavits of support should witness before the immigration officer that whatever is written in the Affidavit is true.

If you are seeking a waiver in the joint filing requirement, the following supporting documents with Form I-751 should be submitted:

  • Copy of death certificate, if spouse is deceased.
  • Copy of divorce certificate, if marriage was terminated.
  • If battered or subject to extreme cruelty, submit evidence of abuse such as reports issued by the police or court.

If you are residing outside the U.S. due to military orders or goverment orders, you should submit the following:

  • Two passport style photographs of the applicant and dependents.
  • If you or your dependents are between the ages of 14 and 79, complete Form FD-258, Fingerprint Cards.

The supporting documents with Form I-751 should be filed for all dependent children who got conditional residence concurrently with you. Carefully prepare the supporting documents, as this would make an easy way for the approval of your petition. Put all the documents in a large envelope and send them to the USCIS. Do not s 00004000 end the original documents to USCIS, unless you are asked to send. If you are requested to send the original documents, USCIS keeps a record of the original documents and returns them back to you. Have a copy of all the documents you send to USCIS, as you may need them for your reference.

The filing fee for the petition includes the application fee and the biometric fee. After USCIS receives your petition, you will be informed about when you should appear for the biometrics.
